Warranty Terms
These Warranty Terms govern the warranty granted for products manufactured and services provided by MerStone OÜ (hereinafter referred to as the Seller) and the procedure for handling warranty claims.
1. Warranty Period
The Seller provides a five (5) year warranty for works carried out by the Seller.
2. Materials and Accessories from Other Manufacturers
Raw materials, sinks and accessories not manufactured by MerStone OÜ are covered by the warranty provided by their respective manufacturer or supplier.
3. Commencement of Warranty
The warranty period begins on the date the product is handed over to the Buyer.
4. Scope of Warranty
The Seller guarantees that, at the time of manufacture, the product complies with applicable technical requirements and is free from material and manufacturing defects.
If such defects occur, the Seller undertakes to remedy them at its own expense.
If the Buyer has a complaint regarding a delivered product, it must be submitted to the Seller in writing together with supporting evidence (e.g. photos, videos).
The Seller may request additional information or send its representatives to inspect the defect if necessary.
5. Validity of Warranty
The warranty applies to products purchased from MerStone OÜ where proof of purchase can be verified.
6. Change of Ownership
The warranty remains valid in the event of a change of ownership, provided that proof of purchase can be established (e.g. installation address or previous Buyer details).
7. Exclusions from Warranty
The warranty does not apply in the following cases:
7.1. If installation was not carried out by the Seller. In such cases, responsibility lies with the installer or the Buyer.
7.2. If the Buyer fails to notify defects within a reasonable time in accordance with applicable consumer protection legislation.
7.3. If the Buyer does not cooperate in resolving the defect or fails to provide necessary information or evidence.
7.4. If the supporting structure or substrate has shifted, settled, deformed or been altered, including due to renovations or reconstruction.
7.5. Damage caused by force majeure (e.g. flooding, storms, lightning).
7.6. Damage caused by improper use or failure to follow care instructions, including exposure to extreme temperatures, UV exposure (including quartz products), chemical or physical misuse, cutting, scratching, impacts or other mechanical damage.
7.7. Mechanical damage discovered after handover that has previously been addressed.
7.8. Damage caused by structural modifications or additions made by the Buyer.
7.9. Changes resulting from the natural characteristics of the material or environmental impact.
7.10. Products beyond the warranty period.
7.11. Products not fully paid for.
7.12. Defects not reported after acceptance of the product.
7.13. Defects that were disclosed to the Buyer during production or installation.
7.14. Variations in texture, pattern or shade. Natural and high natural-content materials may vary and this is not considered a defect.
7.15. Temporary stains or marks resulting from normal use.
7.16. Quartz products used outdoors.
7.17. Silicone defects caused by installation below the recommended room temperature (+15°C).
7.18. Products installed in public or commercial buildings (e.g. restaurants, hotels, retail spaces).
8. Handling of Warranty Claims
Defects under warranty shall be resolved in the following order:
1) Repair of the defective part or installation error.
2) Replacement of the defective part or product.
3) Partial reduction of the product purchase price if repair or replacement is not possible.
4) Partial reduction of installation cost in case of installation defect.
9. Formal Complaint
In more complex cases, the Seller may require a written complaint.
10. Response Time
The Seller shall respond within seven (7) calendar days or after completion of a technical assessment.
11. Repaired or Replaced Products
The warranty for repaired or replaced parts remains valid until the end of the original warranty period.
12. Replaced Parts
All replaced parts remain the property of the Seller for technical inspection.
13. Warranty Work
The Seller organises all warranty repairs during the warranty period.
14. Product Condition
The product must be clean before warranty work is carried out. Any additional cleaning required will be at the owner’s expense.
15. Delivery Without Installation
If installation service is not included, the Buyer must inspect the product upon delivery and report defects within three (3) working days.
After acceptance, responsibility for the product transfers to the Buyer.
